1. Acceptance of Terms
By accessing or using ExposingHate.org ("the Website," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use this Website.
2. Section 230 Safe Harbor
ExposingHate.org is a provider of an interactive computer service as defined by 47 U.S.C. § 230 (the Communications Decency Act).
We are not the publisher or speaker of any user-submitted content. User submissions, including descriptions, context, and commentary, are created entirely by third-party users. ExposingHate.org does not adopt, endorse, or become the publisher of user-generated content by virtue of displaying it.
Users who submit content are solely responsible for the legality, accuracy, and consequences of their submissions.
3. Good Samaritan Moderation
Pursuant to 47 U.S.C. § 230(c)(2), ExposingHate.org reserves the right, but not the obligation, to:
- Remove, edit, or refuse to display any user-submitted content
- Restrict access to any content we consider obscene, harassing, excessively violent, or otherwise objectionable
- Remove content that violates our policies or applicable law, including Texas law regarding doxing and harassment
- Suspend or terminate user accounts for policy violations
Our moderation activities do not make us the publisher of content we choose to leave posted. The exercise of editorial discretion does not create liability for third-party content.
4. Prohibited Content and Conduct
When submitting content to ExposingHate.org, you agree that you will NOT:
4.1 Post Private Information (Doxing)
You may not post private personal information that was not already publicly available, including but not limited to:
- Home addresses or residential information
- Private phone numbers
- Financial information
- Social Security numbers or government ID numbers
- Information about family members not involved in the public conduct
- Employer information for purposes of harassment
This prohibition complies with Texas Penal Code §42.074 regarding unlawful disclosure of residence address or telephone number.
4.2 Make False Statements (Defamation/Libel)
You may not make false statements of fact about any individual. This includes:
- False claims of criminal conduct
- False claims about a person's profession or business
- False statements that could damage someone's reputation
Use opinion language: When providing context, clearly identify statements as your opinion rather than assertions of fact.
Problematic: "This person is a convicted criminal."
Safer: "In my opinion, these comments promote hateful ideology."
4.3 Incite Violence or Harassment
You may not:
- Encourage others to harass, threaten, or harm any individual
- Incite violence against any person or group
- Coordinate harassment campaigns
- Use this platform as a tool for personal vendettas or targeted harassment
4.4 Submit False or Fabricated Content
You may not:
- Submit manipulated or doctored content
- Misrepresent the context or meaning of content
- Submit content involving minors
- Submit content that is clearly satire or parody as if it were genuine
5. User Representations and Warranties
By submitting content, you represent and warrant that:
- Your submission is made in good faith to document genuine hate speech
- The context and description you provide is truthful and accurate
- You have not included any private information not already public
- Your submission does not violate any applicable laws
- You understand you are solely responsible for your submission
6. Third-Party Content
ExposingHate.org displays content embedded from third-party platforms including Twitter/X, Instagram, TikTok, Facebook, YouTube, Reddit, Threads, and Bluesky. We do not host this content; it is loaded directly from the original platforms.
We are not responsible for the availability, accuracy, or legality of third-party content. If original content is removed from its source platform, it will no longer display on our site.
7. Indemnification
You agree to indemnify, defend, and hold harmless ExposingHate.org, its operators, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Website
- Your submitted content
- Your violation of these Terms
- Your violation of any applicable law
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXPOSINGHATE.ORG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR ANY USER-SUBMITTED CONTENT.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the Website after changes constitutes acceptance of the modified Terms.
